What is bail?

Bail is an amount of money deposited with the Court to release someone from custody or quash a warrant.  Bail is posted to insure the defendant will appear at future court hearings.  

Is bail always required to get someone out of jail?

No. Sometimes a judge will release someone from custody on their own recognizance (also called "OR"). The judge will do this if he or she decides the defendant can be trusted to appear at his/her court hearing without posting bail bond.

A judge sets the amount and decides whether all or a percentage of the amount must be posted to secure the release of the defendant or inactivate a warrant.

How does a bail bond work?

A bail bond (or surety bond) is a financial arrangement between someone and a bail bonding agency that is made on behalf of the defendant. A bond is a surety (insurance) that the full bail amount will be paid if the defendant does not appear at a court date or comply with a judge's order.

How much does a bail bond cost?

Bail bond companies charge a fee to issue a surety bond. The fee is a percentage of the total bail amount, payable by the requesting party.

Do you get your money back from a bond?

No. The percentage is the bond company's fee, and you do not get that money back. At the conclusion of the adjudication and sentencing, or dismissal/denial of the charge(s), the bail bond may be exonerated (released back to the bond company).

What is a cash-only bond?

A cash-only bond requires 100% of the bail amount to be posted in cash with the Court to secure the release of the defendant or inactivate a warrant. Cash bail is accepted at the North Las Vegas Municipal Court only during business hours.

Do you get your cash bail money back?

Cash bail will be returned if the defendant is found not guilty or all charges are dropped, less any possible fees assessed by the judge.

If the person is found guilty, the bail money may be applied toward court fines and fees, which means that whoever posted the cash may not get all or any of their money returned.

Where is bail bond paid?

A bail bond may be posted at the North Las Vegas Municipal Court from 7 a.m. to 5 p.m. Monday through Thursday. A $50 bail bond fee is required for each bail bond posted at the Court. After hours and on weekends and holidays, bail bonds can be paid at the City of North Las Vegas Community Correctional Center, 2332 Las Vegas Blvd. North. Cash bail is accepted at the North Las Vegas Municipal Court only during business hours.

Once bail bond has been paid, what happens if the defendant does not appear at a court hearing or comply with the judge's orders?

If the defendant does not appear in Court as scheduled or does not comply with the orders of the Court, the judge may issue a bench warrant. The defendant may also be charged with a new crime called "Failure to Appear". Additionally, any cash bail paid may be forfeited and kept by the Court.

What if the defendant does appear?

If the defendant makes all court appearances and complies with all court orders, the cash bail may be returned to the person who posted it, or the Court may order it be applied toward Court fines and fees.

Who can pick up cash bail that was posted and exonerated?

The Court will mail a check for the exonerated bail to the payor at the address provided to the Court at the time the bail was posted.
